  2. Each person desiring to address the Board shall state his / her name and address.
  3. Individual persons shall be allowed five (5) minutes to address the Board, an extension of time may be granted at the discretion of the Chairperson.
  4. There shall be no questioning by the audience of the persons addressing the Board; however, the Board members may question that person with recognition of the Chairperson.
  5. No person shall be allowed to address the Board more than once unless the Chairperson grants permission.
  6. One spokesperson for a group attending shall be allowed ten (10) minutes to address the Board.

1. Tabled Case No. 06-072 41730 Crane Way filed by Singh Homes Building Com. LLC for 41730 Crane Way Lot 84 Tollgate Woods Subdivision No. 2

Singh Homes Building Company LLC is requesting a Temporary Use Permit renewal for the placement of a temporary construction trailer on Lot 84 of Tollgate Woods at 41730 Crane Way from September 13, 2006 through September 13, 2008. The property is zoned RA and located west of Meadowbrook and north of Twelve Mile Roads.

CITY OF NOVI, CODE OF ORDINANCES, Section 3004 (3), "Temporary Use Permits" states: "The Building Official, or his designee, shall have the power to grant permits authorizing temporary special land uses for…temporary buildings…not to exceed two (2) years in undeveloped sections of the City.

Applicant is requesting a Temporary Use Permit renewal for a construction trailer.

IN CASE NO. 06-072 TO GRANT THE VARIANCE FOR A TEMPORARY USE PERMIT RENEWAL FOR A CONSTRUCTION TRAILER TO BE LOCATED ON LOT 84 OF TOLLGATE WOODS AT 41730 CRANE WAY FROM SEPTEMBER 13, 2006 THROUGH SEPTEMBER 13, 2008 DUE TO THE TIME LIMITATIONS REQUIRED BY ORDINANCE.

 

2. Case No. 06-073 filed by ABC Sign & Awning Design for Crowne Plaza located at 27000 Sheraton Drive

Applicant is requesting one (1) sign variance to have the faces, symbols and wording changed on a nonconforming sign. The proposed sign is located north of I –96 between Taft and Novi Roads and is zoned C.

CITY OF NOVI, CODE OF ORDINANCES, Section 28-14 (b) states: "A non conforming sign: shall not be structurally altered so as to prolong life of the sign or to change the shape, size type or design of the sign"

Applicant is requesting to alter an existing nonconforming sign.

IN CASE NO. 06-073 TO GRANT THE VARIANCE REQUEST TO ALTER AN EXISTING NONCONFORMING SIGN WITH THE CHANGES BEING TO DOWNSIZE THE SIZE OF THE SIGN AND THE VERBIAGE ON THE SIGN.

 

3. Case No. 06-075 filed by William Eland of Wah Yee Associates for David’s Bridal located at 43831 West Oaks Drive

Applicant is requesting a variance to allow placement of an accessory structure (dumpster and enclosure) within a front yard at David’s Bridal, a new tenant space in the West Oaks I, Shopping Center. Property is zoned RC Regional Center and located on the south side of West Oaks Drive at the intersection of Donelson Drive. NOTE: The property contains roads on three sides of the building and the lot is considered to have three (3) front yards.

NOVI CODE OF ORDINANCES: Section 2503.2 (A), states that accessory structures shall be located in the rear yard and shall meet the setback requirements of an accessory structure.

The proposed location of the dumpster enclosure is considered to be within the front yard of the building.

Applicant is requesting a variance to allow placement of an accessory structure within a front yard.

IN CASE NO. 06-075 TO APPROVE THE PETITIONERS REQUEST FOR A VARIANCE TO ALLOW PLACEMENT OF AN ACCESSORY STRUCTURE WITHIN A FRONT YARD DUE TO THE PRACTICAL DIFFICULTY THAT THE SITUATION OF THE BUSINESS IS UNIQUE BEING LOCATED ON THREE FRONT ROADS AND THAT IT GIVES SUBSTANTIAL JUSTICE TO THIS PETITIONER AS WELL AS THE SURROUNDING BUSINESSES. THIS APPROVAL IS SUBJECT TO THE FOLLOWING CONDITIONS: (1) THE ENCLOSURE BE CONSTRUCTED ONE FOOT TALLER THAN THE ACTUAL DUMPSTER AND THE EXTERIOR BE BRICK FACE TO MATCH THOSE PORTIONS OF WEST OAKS THAT ARE BRICK FACE. (2) THE PETITIONER MUST PROVIDE A LETTER GIVING LANDLORD APPROVAL FOR THE USE OF THE PROPERTY.

 

4. Case No. 06-076 filed by Rick Castanos of Varsity Lincoln Mercury for Quick Lane located at 49251 Grand River Avenue

Applicant is requesting three (3) sign variances to erect two (2) 45 square foot wall sign "Quick Lane Tire and Auto Center", one (1) 75 square foot ground sign that includes multiple listings of services provided located at 49251 Grand River Avenue. The property is zoned B-3 and is located on the southeast corner of Grand River Avenue and Wixom Road.

CITY OF NOVI, CODE OF ORDINANCES, Section 28-6 (3) states: "no building or parcel of land shall be allowed more than one (1) sign permitted…"

CITY OF NOVI, CODE OF ORDINANCES, Section 28-6 (2) (a) (i) states: " ground signs shall not exceed a maximum thirty (30) square feet or one (1) square foot for each two (2) feet the sign is setback, whichever is greater…"

CITY OF NOVI, CODE OF ORDINANCES, Section 28-6 (2) (a) (ii) states: ""A ground sign shall not exceed a height of five (5) feet."

Applicant is requesting two (2) 45 square foot wall signs and one (1) 75 square foot ground sign.
