Rules of Conduct:

  1. Each person desiring to address the Board shall state his / her name and address.
  2. Individual persons shall be allowed five (5) minutes to address the Board, an extension of time may be granted at the discretion of the Chairperson.
  3. There shall be no questioning by the audience of the persons addressing the Board; however, the Board members may question that person with recognition of the Chairperson.
  4. No person shall be allowed to address the Board more than once unless permission is granted by the Chairperson.
  5. One spokesperson for a group attending shall be allowed ten (10) minutes to address the Board.

1) Case No. 01-067 filed by Wayne Miller representing Fountain Walk

Wayne Miller representing Fountain Walk is requesting a sign variance to erect non-advertising banners in the development.

CITY OF NOVI, CODE OF ORDINANCES, Section 28-11(b)(2) "Prohibited Signs" states:

"The following signs shall not be permitted, erected or maintained in any district…banners, pennants, spinners and streamers."

Applicant is requesting a variance to allow light pole mounted, non-advertising graphic banners.

MOTION: THAT IN CASE NO. 01-067 (A) TO DENY THE REQUEST FOR BANNERS DUE TO INSUFFICIENT HARDSHIP/PRACTICAL DIFFICULTY

 

2) Case No. 01-086 filed by Delaney Provencher representing homeowners of 112 Rexton

Delaney Provencher is requesting a front yard setback variance of four (4) feet and a side yard setback variance of 7.17 feet for the construction of a dormer at 112 Rexton.

Required front yard setback: 30 feet

Proposed: 26 feet

Variance: 4 feet

Required side yard setback (minimum): 10 feet

Proposed (minimum): 2.83 feet

3) Case No. 01-088 filed by Anthony McGrath representing homeowner of 1256 East Lake Drive

McGrath Construction, Inc. is requesting a rear yard setback of eight (8) feet for the construction of a sunroom located on the lakeside of property located at 1256 East Lake Drive. The proposed sunroom replaces the existing deck at that location.

Johnnie Capron of Collins Signs, representing Home Depot / Kroger is requesting three (3) variances for a monument sign. The variances are for square footage, height and number of on-premises advertising signs.

Square footage requested: 96 square feet

Permitted (based on 92’ setback from centerline of road): 46 square feet

Variance: 50 square feet

Height requested: 8 feet high

Permitted: 5 feet high

Variance: 3 feet

Applicant is requesting permission to erect a monument sign for Home Depot and Kroger. Ordinance permits one sign per parcel of land.

MOTION: THAT IN CASE NO. 00-091 TO DENY THE REQUEST FOR A MONUMENT SIGN DUE TO LACK OF PRACTICAL DIFFICULTY/HARDSHIP, THE CURRENT SIGNS ARE VISIBLE AND THE MONUMENT SIGN IS NOT NEEDED FOR IDENTIFICATION

5) Case No. 00-101 filed by Collins Signs representing Home Depot

Johnnie Capron of Collins Signs, representing Home Depot is requesting a variance to allow a second sign.

Request to install 5’ x 42’-2" (210) square feet channel letters reading "Home Depot" on the right elevation of the building (expressway side).

MOTION: THAT IN CASE NO. 00-101 TO APPROVE THE PETITIONER’S REQUEST FOR A WALL SIGN OF 135 SQUARE FEET FACING THE EXPRESSWAY FOR THE PURPOSE OF IDENTIFICATION

6) Case No. 01-063 filed by Timothy Stoepker representing Jaguar

Timothy Stoepker representing Jaguar of Novi is requesting eighteen (18) sign variances for ten signs to be located at 39500 Ten Mile Road.

Sign A – Wall "service" sign – 1 variance

CITY OF NOVI, CODE OF ORDINANCE, Section 28-8(10) states that "Signs not exceeding two (2) square feet which contain only noncommercial messages…"

Requested: 11.33 square feet

Permitted: 2.00 square feet

Sign B – Wall "Jaguar" sign – 1 variance

CITY OF NOVI, CODE OF ORDINANCE, Section 28-6(3) states "…no building or parcel of land shall be allowed more than one (1) sign permitted under this section…"

The applicant is requesting a 27.35 square foot wall sign

Sign C – Roof "Jaguar Leaper" sign – 2 variances

CITY OF NOVI, CODE OF ORDINANCE, Section 28-11(a) states "A sign not expressly permitted is prohibited."

The applicant is requesting a 50 square foot Jaguar to be located on the roof.

1) Letter submitted to the Building Department

Mr. Saven discussed a complimentary letter addressed to the Building Department and the Zoning Board of Appeals from Mrs. Sandra Marderosian.

2) Mackinac Island conference

Member Reinke discussed the conference that four of the members had attended in October.
